This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Gray Cell Games, LLC ("Developer") governing use of their games and other related content ("Games").
You agree not to:
Copy, re-create or distribute the Games except as permitted.
Create derivative, for-profit works.
Use the Games for commercial purposes without prior, specific written consent.
Games may be used in classroom and educational settings, provided they are not sold, licensed or redistributed for profit without permission.
All rights, title and interest in and to Games, including all content, features, characters, designs, code and audiovisual elements, are owned by The Developer and are protected by applicable intellectual property laws.
The Developer may provide updates, patches or modifications at any time. The Developer reserves the right to modify or discontinue games or any features without notice.
Your use of Games is also governed by their Privacy Policy. The Developer aims to minimize data collection, especially in educational contexts.
If Games are used by children, they are intended to comply with applicable laws, including the Children's Online Privacy Protection Act (COPPA).
Games are provided "as is" and "as available" without warranties of any kind, express or implied, including, but not limited to: fitness for a particular purpose, non-infringement and availability.
To the fullest extent permitted by law, the Developer shall not be liable for any indirect, incidental or consequential damages arising out of or related to your use of Games.
This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, as well as the United States, without regard to conflict of law principles.
The Developer reserves the right to update this Agreement. Continued use of Games after changes constitutes acceptance of the updated terms.
